Please read these Terms of Service ("Terms") carefully before using nooon.online (the "Site") or placing an order. By accessing the Site or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About NOOON

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Site or place an order. By placing an order, you represent and warrant that you meet these requirements.

3. Products & Availability

NOOON offers three fulfillment types:

In-stock items, Available and ready to ship within 3–5 business days.
Preorder items, In production at the time of purchase. Payment is collected upfront. Ships within 3–4 weeks of the stated estimated date.
Made-to-order items, Produced individually after purchase. Payment is collected upfront. Ships within 4–6 weeks of order confirmation.

All product availability is subject to change. An order is not confirmed until you receive a written order confirmation from us. We reserve the right to cancel or refuse any order at our discretion, in which case a full refund will be issued.

4. Pricing & Currency

All prices on nooon.online are listed in US Dollars (USD) unless otherwise stated. NOOON reserves the right to modify prices at any time without notice. The price displayed and confirmed at checkout is the final price you will be charged. Promotional prices or discount codes apply only to the conditions specified and may not be combined with other offers.

5. Payment

Payment is processed at the time of order confirmation. We accept major credit cards, debit cards, and other payment methods available at checkout. By submitting payment information, you represent that you are authorized to use the payment method provided. NOOON uses Shopify Payments and third-party processors to handle transactions securely. Payment information is never stored on our servers.

6. Taxes & Duties

Applicable sales tax will be calculated and added to your order at checkout based on your shipping address. International customers (outside the United States) are solely responsible for all customs duties, import taxes, and fees charged by their country. These charges are not included in the product price or shipping costs and are non-refundable.

7. All Sales Are Final

NOOON operates an all-sales-final policy. Refunds are not offered. By completing your purchase, you acknowledge and accept this policy in full. Exchanges may be offered on a case-by-case basis only in the event of a verified manufacturing defect or shipping error, and only if replacement inventory is available. 8. Cancellations & Modifications

Orders cannot be cancelled or modified after they have been confirmed. For preorder and made-to-order items, production begins immediately upon order confirmation. If you believe an error was made at checkout, contact info@nooon.online immediately; we will attempt to assist but cannot guarantee changes after confirmation.

9. Shipping & Delivery

Shipping timelines and methods are described in our Shipping Policy. Risk of loss and title for items purchased pass to you upon delivery to the carrier. NOOON is not responsible for delays caused by carriers, customs agencies, or events beyond our control.

10. Waitlist & Notify-Me

By submitting your email to a waitlist or notify-me feature, you consent to receive communications from NOOON regarding product availability and related updates. Joining a waitlist does not guarantee purchase rights, pricing, or priority access. You may unsubscribe at any time via the link in any email.

11. NFC Tags & Digital Features

Certain NOOON products include embedded NFC chips that link to digital content or authentication records. This digital content may be updated, changed, or discontinued at any time. NOOON does not guarantee the permanent availability of any NFC-linked content or features. NFC tags are sealed and tampering voids any exchange eligibility.

12. User Accounts

If you create an account on nooon.online, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. NOOON reserves the right to terminate accounts at our sole discretion.

13. Prohibited Uses

You agree not to use the Site to:

Violate any applicable law or regulation
Engage in fraudulent activity or impersonate any person or entity
Scrape, crawl, or data-mine any content from the Site without written permission
Upload or transmit viruses, malware, or other harmful code
Interfere with the security or integrity of the Site
Resell products purchased from NOOON without prior written authorization
Use the Site for any commercial purpose other than purchasing products for personal use

14. Intellectual Property

All content on nooon.online, including photographs, designs, graphics, text, logos, trademarks, and brand elements, is the exclusive property of NOOON or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written consent. Any feedback, suggestions, or ideas you provide to NOOON may be used by us without obligation or compensation to you.

15. Third-Party Links

The Site may contain links to third-party websites or services. NOOON does not control and is not responsible for the content, privacy practices, or availability of those sites. Links are provided for convenience only and do not constitute endorsement.

16. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. NOOON does not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.

17. Limitation of Liability

To the maximum extent permitted by applicable law, NOOON and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or loss of goodwill, arising from your use of the Site or products, even if NOOON has been advised of the possibility of such damages. Our total liability in any matter arising from these Terms shall not exceed the amount you paid for the specific order giving rise to the claim.

18. Indemnification

You agree to indemnify, defend, and hold harmless NOOON and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the Site, or your breach of any applicable law.

19. Force Majeure

NOOON shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, government action, supply chain disruptions, labor disputes, or pandemics.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions.

21. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or the breach thereof shall first be addressed through good-faith informal negotiation. You agree to notify NOOON in writing of any dispute and allow thirty (30) days for informal resolution before initiating any formal proceedings.

If informal resolution fails, any unresolved dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Miami, Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute will be resolved on an individual basis only. You waive any right to bring claims as a plaintiff or class member in any class, collective, or representative proceeding.

22. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Cookie Policy, constitute the entire agreement between you and NOOON regarding use of the Site and supersede all prior agreements, representations, and understandings.

24. Changes to These Terms

NOOON reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Site following any change constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
